Carroll County board agrees to abandon portion of Raid Wade Road if easement is recorded

The Carroll County Board of Supervisors voted to present a resolution to abandon a portion of Raid Wade Road contingent upon the completion and recording of an easement or right-of-way that would preserve access for adjacent properties.
The motion, made by Supervisor Erling and seconded by Supervisor Moore, passed unanimously. County staff and attorneys told the board the neighbors had reached an agreement in principle but that the easement had not yet been drafted or recorded.
The matter was raised during the board’s consideration of a public hearing on road abandonment. Supervisor Erling said the road lies in his Lower Fork District and that he had met with “Mr. Slaughter” and property owners to discuss an access agreement. Mr. Slaughter and the Borjan family, Erling said, “have worked out an agreement between the 2 of them that each 1 of them can access the other's property and travel across it,” but that agreement was not yet on paper or recorded.
County legal counsel advised a conditional approach. “You have 4 months from today's date to act,” Mr. Durbin said, and suggested the board present a resolution with a stipulation that the abandonment be contingent on the recorded easement. Durbin added that if the board takes no action within four months, the parties may pursue the matter in circuit court.
Chairman Early then called the question. The board voted in favor of presenting a resolution to abandon the segment of Raid Wade Road, contingent on the completion and recording of the easement or right-of-way. After the vote, Supervisor Erling told staff he would work with the parties to get the easement drafted quickly; Mr. Newman said he would coordinate drafting with the attorney.
Next steps: county counsel will prepare the conditional resolution for placement on the board’s agenda; the board has up to four months to adopt the resolution, deny it, or allow the parties to seek circuit court action if the condition is not met.
