The Board of Zoning Appeals voted unanimously to approve variances that allow a 17-by-19-foot rear sunroom addition at the Pagrasinski property, granting exceptions for lot coverage and rear-yard setback (dockets PZ202400244 and PZ202400245). Approval was conditioned on consent to encroach from the Board of Public Works and adoption of findings of fact.
Jeremy Place of West Design Build presented the application, telling the board the addition will replace an existing screened enclosure and sit on an existing concrete slab with new footings. "I'm here to request the variance, the lot coverage variance, for the room addition that we're building, 17 by 19, in place of a current screen enclosure," Place said.
Why it matters: Planning staff noted a 15-foot-wide drainage easement in the backyard and recommended approval only if the applicant obtains a consent-to-encroach from the Board of Public Works. The BZA adopted that condition and asked legal counsel to review the drafted findings of fact prior to finalization.
Details and conditions: The planning department recommended positive consideration with the condition that the applicant secure the Board of Public Works consent to encroach for work affecting the drainage easement. One board member requested legal counsel review the findings of fact language before the findings are finalized; counsel agreed to prepare and provide that review. After discussion, the board voted 5-0 to approve the variances and adopt findings of fact contingent upon counsel’s review.
Next steps: The applicant must obtain consent to encroach from the Board of Public Works and complete any required permits and inspections before constructing the addition.
