The Board of Zoning and Appeals voted to approve a conditional use permit that will allow Chandler Properties’ tenant, Apple’s Roofing, to operate a roofing-related business at 811 Memorial Boulevard, the board decided during its meeting. The permit passed on a 4-0 roll-call vote.
Under the zoning ordinance, roofing contractor operations are not permitted in the parcel’s zoning class, but the ordinance allows contractor and professional services offices indoors with a conditional use permit if storage remains inside and operations do not negatively affect surrounding neighbors. A staff member told the board that staff mailed letters to adjoining property owners and that no phone calls or comments were received; on that basis staff recommended approval of the permit.
Ethan Mackie, who identified himself as a representative of Apple’s Roofing, told the board the company does not perform construction work on-site. “We’re more of a consultant with the insurance carrier and the homeowners. We don’t do any of the construction or any of the contracting work ourselves,” Mackie said. Board members asked where equipment would be kept; Mackie said the business does not maintain equipment at the site.
Board members briefly discussed whether the conditional use permit should include a time limit. A staff member said conditions can be attached if the board wishes; one board member suggested a condition tied to a future change of property ownership. The board did not record a separate timed condition as part of the motion on the record.
When the board called the roll on the motion to approve the conditional use permit, members recorded the following votes: Briggs — yes; Simmons — yes; Woodard — yes; Piechecker — yes. The motion carried 4-0.
