Ways and Means introduces RS32362 to let secretary of state update UCC forms without amending code

Representative Jeff Ehlers introduced RS32362 to the Ways and Means Committee on Jan. 22, 2025 on behalf of the secretary of state's office. Ehlers said that current UCC filing forms are embedded in code as images, so any minor change requires a statutory code amendment. RS32362 would remove those images and allow the secretary of state to publish and modify the required forms consistent with the Uniform Commercial Code.
"So what this does is it eliminates the pictures from the form and instead just says that the secretary of state can create the form, following the Uniform Commercial Code," Ehlers said. The sponsor asked the committee to introduce the RS so the office can proceed with the technical update.
Representative Tanner moved to introduce RS32362; the committee approved the motion and the RS was introduced for further consideration. The committee did not adopt any final rule or implementation at the meeting; the change is procedural to allow form updates without code changes.
