Portico Place sign variance denied after staff flags gas-main conflict

Smyrna’s Board of Zoning Appeals denied a requested sign-setback variance for Portico Place Townhomes after staff found the proposed northern entrance sign location overlapped a gas main.
Mitch (staff) presented the application, saying the town’s sign ordinance requires a 75-foot setback from the center point of an intersection. He told the board the northern proposed sign “is shown on top of a gas main which will not be allowed by our utilities department.” Staff said one option would be to locate a smaller sign within the subdivision’s common area where utilities are not present.
Board members discussed whether the signs could be reduced in size or relocated within common-area land and clarified that sign placement is not reviewed as part of a subdivision plat; signs need a separate permit. A motion to deny the requested setback variances was made, seconded and approved by voice vote; staff advised the applicant to pursue permitted options, including relocation within the common area and utilities clearance.
The denial applies to the particular variances requested; the developer may revise sign size or location and reapply with permits and utilities approvals.
