The Zoning Board of Appeals for Fall River City on Feb. 20 tabled a petition by Marino z. Benavides to divide a single parcel that contains three existing multifamily buildings at 84 Everett St., 94 Everett St. and 310 Alden St.
Attorney David Asad, representing the petitioner, told the board the parcel historically contained the three buildings and that the request seeks a special permit under Section 86-4-23(b) of the City of Fall River zoning ordinance to create three separate lots, each to contain one of the existing dwellings. Asad said sewer connections appear separate for some buildings and asked the board to require boundary markers if the division is approved.
Board members raised concerns about inconsistencies on the submitted plan, including the unit count for 94 Everett Street. Asad said 94 had been shown as a three-family on the application but assessor records indicate it may be a four-family, and the plan submitted to the board did not match assessor field cards. The chair moved to table the petition so the applicant can correct the plans and, if appropriate, amend the petition to request authorization for a four-unit configuration at 94 Everett.
There were no members of the public who spoke in favor or opposition when the chair asked. The board took a roll call on the motion to table; the motion passed with five affirmative votes (Ricky Sahadi; Dan DePere; Jim Calkins; John Frank; Chairman Joseph Perera). The board set the next hearing date for March 20, 2025.
The board and counsel noted converting a former bakery or commercial space to a dwelling may require a separate filing if the prior use has been discontinued more than two years, and asked the petitioner to check building-department classifications before returning.
The petition remains pending; the board did not make findings on the merits pending corrected plans and clarification of unit counts and existing uses.
