Council amends Copper Canyon development agreement to dedicate sewer easement and reduce some lot sizes

The Tooele City Council on Feb. 19 voted 5-0 to approve Resolution 2025-08, amending the Copper Canyon development agreement to convey a 12-foot sewer easement to the city and to allow certain future lots to be reduced to 5,000 square feet.
Andrew Agard, Tooele City Community Development Director, told the council the change follows a recent planned-unit-development (PUD) amendment that reduced lot sizes so a sewer easement at the rear of lots could be accommodated. Under the development-agreement amendment, the easement would be conveyed to the city by deed, warranty deed or plat recordation so the city would retain access and maintenance responsibilities for utilities.
Council members asked whether the easement will be physically identified to prevent future encroachment; staff responded that the PUD does not require a fence but that the city intends to demarcate the maintenance road or alley with materials such as gravel during final platting so it is clearly separate from private lots.
Councilman Hansen moved to approve Resolution 2025-08; Councilwoman Goches seconded. The council voted Aye: Councilwoman Manzion, Councilwoman Goches, Councilman Hansen, Councilman McCall and Councilman Brady. The motion passed 5-0.
Why it matters: Dedicating the easement to the city secures ongoing access and maintenance for sewer infrastructure and aligns the development agreement with the previously approved PUD changes.
