The motion followed a closed-session review of property and negotiation strategy and was introduced by Commissioner Krueger and seconded by Commissioner Nagel. County Attorney Ryan Henshin summarized the legal description provided by the project engineer and said the payment would allow the realignment work to proceed. The motion also directed the auditor-treasurer to issue a $12,000 check to Lotus Holdings upon receipt of a W-9 and delivery of the required easement documents.
The board opened a special meeting of the drainage authority for County Ditch 18, moved into a closed session to discuss offers and counteroffers for the purchase or sale of real estate, and returned to public session to record the action. Commissioners signaled unanimous support on the recorded voice vote; the chair announced the motion carries.
County staff said the easement and payment follow the engineer’s legal description of the planned realignment for CD 18 and were presented as the lowest-cost option to allow work to proceed after landowner delays. The attorneys present—county counsel and outside water counsel—had reviewed the proposed offer prior to the vote, county officials said.
The drainage authority adjourned the special meeting on County Ditch 18 after approving the easement authorization and associated payment instructions.
The board did not provide a copy of the final easement at the meeting; staff said the easement documents and payment would be completed according to the engineer’s legal description and that the auditor-treasurer would issue funds once a W-9 is received.
