The board approved a variance allowing a tall privacy fence to remain at 1834 Highland Avenue provided the petitioner moves the fence back to align with the corner of the house to address front-yard setback requirements.
Joanne Lopez, representing Holly Oasis LLC, said the fence was replaced to protect short-term tenants and prevent break-ins: “It’s become a safety concern of ours,” she told the board and said the company had provided photos and video of attempted thefts. Staff confirmed the fence was built on the front property line and that the R60S front-yard setback is 20 feet.
Board members discussed setback options and ultimately approved a motion requiring the petitioner to move the fence back to align with the corner of the house (board members described that as about 15 feet in this case) while allowing the current height to remain. The motion passed by voice/hand vote. Staff said the complaint originated as a 311 call and that no neighbors were present in opposition.
The petitioner agreed to comply with the relocation requirement and asked for clear guidance on the required setback; staff said they would provide the fence setback and coop/permit guidelines as applicable. The board recorded the condition and will follow up to ensure the fence is moved as directed.
