Continuances and hearings
- Sconset Beach Preservation Fund (Baxter Road) — continued to March 12 for scheduling a special conservation commission meeting (daytime start, 10 a.m. discussed). (Applicant: Sconset Beach Preservation Fund; item continued.)
- Town of Nantucket — Ames Ave and Diana's Beach (pilot dune project) — hearing continued to March 6 so Natural Resources staff can supply final materials and monitoring protocols; applicant said work is time‑sensitive because of bird‑season restrictions.
- Wolfram Family Trust (7 Folger Lane) — continued to March 6.
- Lydia Denny Palmer LLC (110 Wahwinet Road, fence waiver request) — continued to March 6 for the applicant to present alternatives and further justification for a fence within the 50‑foot buffer.
- Ned Site Management LLC (shoal dredging at 34 Straight Wharf) — continued to March 6 because legal advertising and a DEP file number were not completed; applicant reported emergency dredging was performed Jan. 6 under emergency WPA certification (Dec. 16).
Closures, decisions and orders
- 14 Tatima Way (SC 483840) — hearing closed on condition that the applicant submit groundwater elevation data and pool/shed schematics prior to the start of construction; the commission recorded a roll call: five commissioners in the affirmative, commissioner Turcotte recused and one abstention. (Condition requires commission review; if submitted data show noncompliance, the pool must be removed or revised.)
- Powers (36 Bassett Road, SC 483871) — hearing closed unanimously; staff recommended closure after a site visit and required HDC application was filed.
Permits, orders of conditions and certificates
- Orders of conditions issued for 72 & 78 Pachela Road (coastal engineering/shoreline permits) — the commission voted to issue the orders with monitoring and survivability conditions; recorded outcome carried with a majority in the affirmative (commissioners in favor: multiple; two commissioners opposed on record). The orders include georeferenced photo monitoring, specified survivability thresholds for plantings, and a requirement to file a new NOI if failure criteria are met.
- South Slip LLC (29A Old North Wharf, SC 483892) — order issued permitting replacement of a damaged wave fence; vote carried unanimously.
- Certificates of compliance (McCausland, Smooth Hammocks Way / associated file numbers) — staff and applicant confirmed work was in substantial compliance; COCs were approved unanimously.
Enforcement and other business
- Staff reported active enforcement files and upcoming hearings; the commission reiterated it can compel compliance through civil enforcement and, if necessary, other legal routes. Several monitoring reports from the Land Bank and Conservation Foundation were filed; commissioners may request follow‑up as needed.
