Senate approves bill letting townships reclaim zoning authority from counties if conditions met

Senate Bill 23-17, a bill to require a county to return township zoning authority to a township that requests it and meets statutory conditions, passed the Senate 27–20 on Feb. 20, 2025.
Sponsor Senator Magram said the measure restores local control for townships that previously ceded zoning authority to the county, often because population declined and residents stopped attending township meetings. Supporters said reorganized townships seek the ability to address local matters — not large infrastructure items such as pipelines, which are preempted — and that the bill requires a township vote and procedural steps to regain authority.
Opponents, including Senator Roars and members of the state and local government committee, urged a do-not-pass recommendation, arguing the bill could create a patchwork of zoning rules across neighboring townships and counties and that some testimony showed local motives were driven by opposition to individual projects. Senator Lee, drawing on planning-and-zoning experience, encouraged collaboration between counties and townships and warned against inconsistent rules along borders.
Proponents also pointed to political and demographic shifts in some townships where younger families are returning and want local decision-making. The bill ultimately passed on final reading 27–20.
