York County Council approved first reading of an ordinance to add an administrative-adjustments procedure to the county zoning code on Monday night, Feb. 17, allowing staff to approve minor deviations (generally up to 10%) from quantitative development standards in certain circumstances.
The amendment, presented by planning staffer Jonathan Buono, would create a formal process for small numeric variances — for example, allowing a 90-foot lot width where 100 feet is required — without requiring a property owner to pursue a variance before the Board of Zoning Appeals (BZA). Buono said the proposal targets “the oh‑so‑close” situations that impose time and cost on applicants.
Supporters say the change will streamline routine applications and reduce the number of cases that must go before the BZA. Buono told council that the measure follows the practice of neighboring jurisdictions and that the proposed 10% limit includes exclusions for more sensitive criteria. "There are some exclusions written into that, so for some of the more sensitive quantitative standards in the code, like overlay district standards, special district standards for PD districts, lot size, density and use separation, those are all excluded," Buono said.
The Planning Commission recommended approval 7‑0. During council discussion, members asked staff to return with details about the expected application timeline and whether a modest fee would be charged to cover staff time. Buono told the council an administrative adjustment would likely follow a process similar to a zoning compliance request and could be handled in roughly two weeks if the submittal is complete; he estimated a modest fee similar to existing compliance fees would be appropriate but said the amount would need to be finalized.
Council moved and approved first reading with no recorded opposition; the council asked staff to provide timelines and a proposed fee schedule before second reading. The ordinance text amendment applies countywide but explicitly excludes certain numeric standards and does not remove the applicant’s right to seek a variance from the BZA when appropriate.
Planning staff emphasized that the amendment is intended to save applicants time and cost while protecting neighbors through approval criteria and the ability to attach conditions to an administrative approval. The council expressed support for the concept and requested more detail on implementation at second reading.
