Council approves vacation of 15-foot strip to allow Oasis Market expansion

The Newman City Council on Jan. 14 adopted a resolution vacating the southern 15 feet of an unnamed section of right-of-way located 180 feet north of Scott Road, a move staff said will allow the owner of the Oasis Market to plan a larger convenience store and add pumps and circulation improvements.
City staff told the council the strip of right-of-way lies on the northern entrance to town, adjacent to the Oasis Market and opposite the San Luis Convalescent Hospital, and that vacating the 15 feet would convert that portion from public right-of-way to private property tied to three assessor parcels (APNs 026-040-002; 029-040-020; 029-040-025). Staff said the owner intends to submit a site plan that could include expanded pump stations and a drive-through or co-branded tenant.
The city’s action tonight authorizes the vacation process; final transfer of the land requires a legal description, recordation and site-plan approval by the planning commission. Staff said conditions of site-plan approval would require the developer to construct the street improvements (curb, gutter and sidewalk), bring lighting into conformance with city standards and define vehicle circulation to improve ingress and egress. The staff presentation noted that if the site plan is approved, the vacated portion would become private property and subject to property taxes.
No members of the public spoke during the hearing. After a motion to adopt the resolution, the council voted to approve the vacation 5-0.
If the planning commission later approves the applicant’s site plan, the property owner must complete the legal process to record the vacation and implement the required street and lighting improvements before the city will recognize the transfer of property rights.
