Staff described the council action as an internally driven modification based on nuisance concerns brought to city departments rather than a modification requested by the permit holder.
Several commissioners said they would prefer to have input and were concerned that the planning commission had been bypassed; staff and the city attorney’s guidance, as relayed at the meeting, was that council has the authority under that code section to act. Commissioners were advised they could attend the council meeting and comment as individuals; staff also cautioned against speaking as the commission on a non-agendized item.
No formal action on the conditional-use permit was taken at the planning commission meeting; staff noted the matter was scheduled for the next city-council meeting.
