The Planning Commission voted unanimously to approve a two-year extension of the conditional use permit (CUP) and development review permit for a renewable natural gas (RNG) fueling facility at 2200 North Chrisman Road.
Kelly Jones, assistant planner, told the commission the project had been approved previously on May 25, 2022 but had not commenced "due to no fault of the applicant" and that staff had determined the applicant had demonstrated good cause for an extension. Jones said staff recommended approval of the extension request.
The extension length and timing were clarified during the hearing: the original approval had expired in June 2024, and the commission approved an additional two years, extending the permits through June 2026. Jones said the applicant had requested two years and the municipal code allows the planning commission to approve up to a two-year extension.
There were no public comments for the item. A commissioner moved to adopt a resolution approving extension 24003 of CUP21-007 and development review permit D21-0023 for the RNG fueling facility and determining the project exempt under CEQA guideline section 15183; the motion was seconded, and a roll-call vote recorded unanimous approval.
The commission’s action preserves the prior discretionary approvals and gives the applicant additional time to finalize permits and building approvals; staff noted the building permit was likely ready to be issued and that the extension would provide “ample time” to complete the project.
The commission did not place new conditions on the extension during the hearing. Staff will process remaining building permits and ensure the project continues to comply with the previously adopted conditions of approval.
