At an Avon Board of Zoning Appeals meeting, the board approved a two-month continuance to the April 15 hearing for petitions SE2405 and VAR2407 concerning 7893 East U.S. Highway 36, property associated with the Lowe’s site.
Staff told the board the continuance was requested because an outstanding condition from earlier approvals requires Lowe’s to provide an access drive connection to Vista Parkway, and staff and the petitioner continue to seek a corporate-level resolution. Staff recommended a two-month continuation instead of a single-month continuance to allow time for that coordination.
Staff said the access-drive issue dates back more than 20 years and reappeared when a similar request to create an outlot was considered in February (2015 approvals had lapsed because construction did not commence). The petitioner asked that the matter be continued while they pursue the unresolved access condition with Lowe’s corporate representatives.
Board members expressed support for delaying action until the access issue is resolved. The board approved the continuance to April 15 without requiring additional published notice; the petitioner is responsible for mailing notice to required recipients. The transcript record shows a roll-call vote recorded as unanimous by the five members present (Paul Guchenberger; Anne Inman; Catherine Ransberg; Marci Taschler; Marcus Turner). No member was recorded voting against or abstaining.
The continuance does not decide the underlying petitions or any variance requests; it pauses formal action until the April 15 hearing so the access-connection matter can be worked out. Staff indicated the two-month continuance is intended to provide time for the petitioner and Lowe’s representatives to resolve the outstanding condition before the petitions are considered again.
