Emily Yershus, a representative from Planning and Development Services, told the board the lot was platted in 1988 and annexed into the city in 1997, at which time R-1E zoning was applied. "The recorded restriction for the property establishes a 40-foot rear yard setback, while the R-1E zoning district requires a 50-foot rear yard setback," Yershus said.
