The appraisal and conservation‑easement action matters because it converts an eligible parcel into a permanent sending site under Milton’s TDR program, removing subdivision rights while allowing the owner to market TDRs to developers seeking additional density in designated receiving areas such as Deerfield or Crabapple.
Bernadette (the city clerk) read the consent agenda, which the council approved without separate discussion. The consent agenda included:
- Approval of the Feb. 3, 2025 regular meeting minutes (agenda item 25039).
- Approval of the Feb. 10, 2025 joint work session minutes of the city council and planning commission (agenda item 25040).
- Approval of a services agreement with ProLogix ITS LLC to install emergency equipment in new police vehicles (agenda item 25041).
- Approval of a professional services agreement with Geo Hydro Engineers, Inc. for subsurface exploration and geotechnical evaluation at 300 Deerfield Parkway (agenda item 25042).
- Approval of a revised purchase agreement for 0.457 acres of temporary construction easement at 13450 Cogburn Road, North Park from the City of Alpharetta for the Big Creek Greenway Extension Project, PI 0015078; this revised purchase agreement was previously approved May 6, 2024 (agenda item 25043).
Robin McDonald, zoning manager, presented the TDR conservation‑easement request for a property owned by Jana Chevalier at 2200 Birmingham Road. McDonald said the property met the code criteria for a sending site (minimum 5 acres, AG1 zoning and features that support the city’s rural and environmental goals) and staff recommended the council authorize the city to hold the easement. McDonald explained that under the program the easement keeps the land in private ownership but limits future subdivision; the owner would receive TDR credits that they may sell in a private transaction to developers seeking density at designated receiving sites.
McDonald said the property is 6.7 acres, currently used as pasture with a wooded northwest section, and that the applicant would create seven TDRs if the easement is approved. She said the city has a small TDR bank: 22 TDRs exist and 17 have been sold to six projects (four in Deerfield, two in Crabapple).
Council member Kerkle moved to authorize the city to hold the conservation easement; Council member Kramer seconded. The motion carried unanimously. The council recorded the vote as unanimous and the clerk announced the motion passed.
