Under the proposed cost‑share approach — the same percentage split used for the initial ask — Clay County's requested additional contribution ranged from $58,500 (for a smaller extra request) up to $78,000 if the larger supplemental need materializes. County staff and commissioners discussed potential use of riparian-repair/protection aid under Minnesota law as a funding source; County Attorney/administration staff provided a preliminary, cursory review of Minnesota Statute 103F.048 and said it did not obviously prohibit the use, though staff did not offer a definitive legal opinion at the meeting.
Commissioner Kavanagh moved to approve additional funding up to $78,000 from riparian aid to complete the judicial formation; Commissioner Bair seconded. The motion passed by voice vote and the board instructed staff to return with any necessary follow-up if the funding source needs to change to general fund balance.
Staff said the expectation is that EPA grant funds, if awarded this summer, can reimburse the county once received; until then the requested additional appropriation would allow the project to continue on schedule.
