Commission reviews rules of procedure; members flag sunshine-law language and absence policy

Commissioners reviewed the Planning Commission’s rules of procedure (referred to in the meeting as bylaws) and discussed several clarifications staff and members said were needed to align the rules with council policy and open-meeting requirements.

The debate focused on how the commission should handle special meetings and removal for absences. Commissioners flagged a passage that currently says a special meeting “shall be called by the chair” and that it “shall be the duty of the chair to call a special meeting when requested to do so by a majority of the members.” Members raised a concern that the wording could conflict with the state’s sunshine law if it allowed members to coordinate outside a public meeting.

“I think this mirrors the charter,” one commissioner said, urging clarity on whether the chair or a majority of members can initiate a special meeting. Another commissioner suggested changing the language to say the chair or a majority may call a special meeting to avoid ambiguity.

Commissioners also discussed absence and removal rules. Staff noted that the council has updated its handbook and that sections in the rules (referenced during the meeting as Section 5.03, 5.09 and 5.10(d)) address removal for absences. Planning staff said they would share the council handbook and recommended edits so the commission’s bylaws remain consistent with the council’s expectations.

Commissioners asked staff to circulate an editable copy of the rules so members can propose specific edits before an April meeting. No formal amendments or votes were taken at this meeting; staff said they will return with a marked-up draft for future commission consideration.
