Plan Commission approves acquisition of small triangle at 420 N. Main to regularize City parking lot

The Oshkosh Plan Commission on Feb. 19 approved staff recommendations to acquire a small triangular (153-square-foot) portion of land at the southwest corner of 420 North Main Street from Escape Rentals LLC so the city-owned 400 block west parking lot no longer encroaches on private property. The roll-call vote was 6-0.

Staff said the city resurfaced the parking lot in late 2023 and identified property-ownership issues that needed correction; most issues have been resolved through a combination of right-of-way vacations and land swaps, and this acquisition is the last piece needed before a certified survey map can combine parcels for the parking-lot configuration. The proposed triangular parcel measures roughly 15 feet by 20 feet (153 square feet). Without the acquisition, staff said the city could be required to remove pavement or relocate two handicap stalls and a central loading area.

Staff said the city contacted the property owner, Rebecca Croft of Escape Rentals LLC, who agreed to transfer the small area to the city. The city attorney's office prepared a quitclaim deed, and staff told the commission the deed includes a reverter clause: if the city sells the property or stops using it as a public parking lot within 20 years of recording, the original owner may demand reacquisition.

Commissioners asked whether the owner received compensation; staff responded the owner did not receive compensation. There was no public comment. The commission moved to adopt the staff report findings and recommendations; roll-call votes recorded all members voting yes and the motion carried 6-0.

Next steps include completion of the deed recording and subsequent mapping and any final lot consolidation needed for the parking-lot parcel.
