The House Judiciary Committee on Monday voted 12-0 to give a "do pass" recommendation to Senate Bill 2077, which would allow the superintendent or director of a treatment facility to petition the court to transfer an individual who was found not guilty by reason of lack of criminal responsibility to a less-restrictive setting for court-ordered examination.
Dr. Dan Kramer, clinical director with the Human Service Centers at the Department of Health and Human Services, testified in support of the engrossed bill, saying it responds to a limited set of cases in which a less-restrictive, structured treatment setting may be more appropriate than the North Dakota State Hospital for the statutorily prescribed examination period.
