The House Human Services Committee amended House Bill 13-91 to add a section creating a health-status exception for health-care facilities, a change committee members said was requested to accommodate federal Centers for Medicare & Medicaid Services (CMS) rules. Representative Rohrer described section 13 as a targeted addition that exempts health facilities from certain provisions of the bill when compliance would conflict with CMS regulations or bona-fide requirements. The committee member said nothing else in the nine-page bill was changed aside from the new section and the prefatory line explaining the new insertion.
After brief discussion, the committee approved the amendment by voice vote and later recorded a roll-call vote on the due-pass motion. The clerk’s tally recorded the committee’s recommendation as 9 yes, 3 no, 1 absent.
Committee members said the change was intended to prevent federal regulatory conflicts and to preserve facilities’ ability to follow CMS requirements.
