The East Lansing City Council voted unanimously on Feb. 18 to enter a closed session under Michigan’s Open Meetings Act (MCL 15.268(1)(c) and (1)(e)) to discuss collective bargaining negotiation strategy and to consult with the city attorney about trial or settlement strategy in pending litigation.
The litigation was identified in the motion as City of East Lansing v. Alternative Service Concepts LLC d/b/a Davies Claim Solutions and certain underwriters at Lloyd’s London, subscribing to policy number PK1001512, United States District Court for the Western District of Michigan, case No. 1:24‑CV‑00635. The council’s closed‑session motion said that an open meeting could have a "detrimental financial effect on the litigating or settlement position of the city."
After returning to open session, Council member Watson moved to accept the proposed settlement offer from Alternative Services Concepts, LLC (d/b/a Davies Claim Solutions) and the underwriters identified in the litigation and to authorize the city manager to execute all necessary documents. The motion was seconded by Council member Meadows and passed unanimously.
No settlement amount or confidential terms were disclosed in the open meeting. The motion authorizes the city manager to finalize the paperwork on behalf of the city.
