The Hayward City Council on Jan. 21, during a closed‑session meeting convened under the Brown Act, approved a settlement in litigation with Union Pacific Railroad that will result in the city receiving approximately $350,000 for environmental violations.
City Attorney staff reported the council convened at 6 p.m. with all members present and that there were no public speakers for the closed session. The matter discussed in conference with legal counsel was "City of Hayward versus Union Pacific Railroad," and after discussion the council approved a settlement. Council member Zirmejos moved the settlement and Mayor Pro Tem Julie Roach seconded; the vote was unanimous.
City staff also told the council they will continue to pursue a maintenance agreement with Union Pacific Railroad related to the matter.
The settlement was reported out at the council meeting; staff described the figure as "approximately $350,000." No additional terms were disclosed in the public report.
