Planning staff member Mr. Luthy told the board the state issues the primary fireworks permits but the city must verify local zoning compliance before the mayor and planning director sign local paperwork. “These permits… are with the state,” Luthy said, adding that the city’s temporary‑use rules in the C‑2 district permit seasonal retail sales with review and that the Board of Zoning Appeals should review the applications before local signatures are provided.
The permits cover TNT Fireworks East locations listed to the board as 2111 North Jackson Street, 1905 North Jackson Street and 449 West Lincoln Street; the applicant was not present at the hearing. Mr. Sellers made the motion to approve the three permits and Mr. Hall seconded. Board members said the sites are in existing shopping‑center parking areas and noted a history of similar stands at those locations without recent complaints.
Staff clarified the next step: after state review and issuance of any required state vendor permits, proponents must obtain the city’s temporary/retailer fireworks permit (the city issues a related local permit) and return to the board as required by local process. The approval recorded by the board authorizes staff to proceed with local review and signatures; final local permitting is contingent on compliance with zoning and any additional local permit requirements.
