Committee sends landlord-tenant code reorganization bill, removing last reference to 'coverture', to the floor

Senator Ali Rabbe (District 16) presented Senate Bill 1043 to the Senate Judiciary & Rules Committee, describing the measure as a reorganization of Idaho’s landlord-tenant code with one substantive change: removal of the last remaining reference to “coverture.”
“My name is Senator Ali Rabbe and I represent District 16,” Rabbe said. He told the committee the bill consolidates scattered landlord-tenant provisions that currently appear across Title 55, Chapter 3 and Title 6, Chapter 3 and moves the most commonly used provisions—lease termination, rent increases, changes in lease terms and the provision on preemption of local regulation—higher in the code for easier access.
Rabbe described the single substantive edit as deleting an historical reference to coverture, a 19th-century legal doctrine under which a married woman lacked an independent legal identity. “The 1 substantive change we made to these sections of code removes the 1 remaining reference to coverture in Idaho code,” he said, adding the reference dates to territorial-era code and earlier common-law sources.
Senator Keiser moved to send Senate Bill 1043 to the floor with a due-pass recommendation; Senator Foreman seconded. The chair called a voice vote; senators answered “Aye,” and the chair announced the motion carried. The committee did not receive public testimony during the hearing.
The committee’s action forwards the reorganized statutory text for floor consideration; no other substantive policy changes were discussed in the hearing.
