Commission postpones Legacy West zoning amendment to March 3; fire-code variance still under review

The Plano Planning and Zoning Commission on Feb. 17 granted a request to table consideration of a planned-development amendment for the Legacy West area to its March 3 meeting.
Destiny Woods, planner with the planning department, told commissioners the petition from Legacy West Investors LP seeks modifications to open-space and sign development standards on about 275.1 acres at the northeast corner of Legacy Drive and Communications Parkway within the Dallas North Tollway Overlay District. Woods said the applicant asked to postpone while a requested variance from the fire code remains under review.
Commissioners discussed the commission's procedural option to require a re-notice fee after multiple postponements. Commissioner Brunoff asked whether, at a third postponement not requested by the applicant, it would be appropriate to include a motion waiving the re-notice fee; staff said the commission has the discretion to postpone to a definite date and that the current practice allows indefinitely postponing at the third tabling but that re-notice could be required for indefinite postponements. A motion to table to March 3 was made and seconded and passed 8-0. One registered speaker, Bill Lyle of Lyle Inc., was listed but was not present when the commission called for public comment.
Staff said the fire-code variance remains under review and is linked to the zoning case; no final action on the zoning amendment took place.
