Swain County Board reverts Title IX'related policies to 2020 versions after legal guidance

Swain County Schools moved quickly to revert Title IX'related policy language to earlier versions after receiving guidance from the district's legal counsel and regional attorneys.
Tommy, the district's identified Title IX coordinator, told the board that counsel recommended rescinding current interim policy language and reinstating policy versions adopted on July 28, 2020. Board members were told the change was recommended to align district policy with recently issued federal executive actions and to avoid a mismatch between the district's policy language and federal standards that could affect funding or the handling of complaints.
The board voted to waive first reading and to adopt the reversion for the policies identified in the packet (policies referenced in the meeting as 1710 and 1720, and interim policies 1725 and 1726). Tommy and legal staff said they would prepare a side-by-side comparison of the changed language for the board's records.
Why it matters District counsel said the reversion reduces the risk that a complaint filed under the current interim language would be handled under guidance that may conflict with the federal directives in effect; the board accepted counsel's recommendation and asked for a clear redline comparison of the versions.
