Commission approves waiver allowing up to five trucks at 3108 W. Catherine Drive; limited to current owner and to be recorded

Finney County commissioners on Jan. 27 approved a waiver request by Lisa Contreras (applicant) to allow up to five semi trucks and trailers to be parked at 3108 West Catherine Drive, a 3.17-acre rural-residential property that previously received a permit for one truck and trailer.

Planner John Persisto explained the RR (rural-residential) district allows one semi truck and trailer as a conditional use and staff had recommended a conditional-use permit for one truck. The owner later requested permission for more vehicles. Persisto told the board an earlier, similar waiver (3095 Mason Court) had been limited to five trucks and recorded and that staff had no formal recommendation on this waiver.

Commission discussion noted neighbors on a prior, similar waiver supported the arrangement, and some commissioners said there are limited truck-parking options in the community. Commissioners amended the motion to restrict the waiver to the current landowner and to limit it to a total of five semi trucks and trailers; the board directed that the waiver be prepared, filed of record, and run with the land and be limited to the current owner. The motion carried. One commissioner voted nay on procedural grounds because adjoining landowners had not been given notice or an opportunity to comment on the waiver extension; the motion nevertheless carried.

Next steps: county counsel will prepare the waiver language for recording, and staff will ensure the waiver is filed with the register of deeds and tied to the property and current owner as directed.
