Legislative Council approves $10,000 amendment for outside counsel in Janus litigation

The Alaska Legislative Council on Feb. 12 approved amendment No. 1 to an existing outside counsel contract for the Janus litigation, adding $10,000 and raising the total contract amount to $110,000.
Megan Wallace, chief counsel for Legal Services, told the council the request was to ensure sufficient funding to cover the final costs at the Superior Court level where both parties had filed cross motions for summary judgment and oral argument was scheduled in Anchorage the following day. "This request is to ensure that we have sufficient funding to cover the final cost, at the Superior Court level, and should cover the cost of completing litigation at this stage," Wallace said on the record.
Wallace explained the litigation arose after an audit examining legislative appropriations to the Department of Law in FY 2021 and FY 2022 and whether the Department of Law was authorized to contract for outside counsel in matters related to the United States Supreme Court Janus decision. The council approved the amendment after Wallace’s explanation and no further questions were recorded.
