The Mound City Council on Feb. 11 approved a resolution authorizing a voluntary abatement agreement for the property at 1583 Dove Lane after city and county inspectors found the building in a hazardous condition.
City staff explained the agreement is intended to give the city tools to enforce abatement if the hazard is not corrected while offering property owners a voluntary path that avoids immediate court enforcement. Staff said a purchase agreement for the house was entered during the abatement process and the purchaser was added to the abatement instrument.
Community Development staff reviewed the timeline and materials in the resolution and noted a small amendment was required in the exhibit before approval. Council members questioned whether the proposed timetable was realistic and whether the city could avoid using taxpayer money if staff had to perform abatement work. Community Development staff and the owner, Stacy Roxbury (identified in public comment), both told the council the owner had proposed the time frames, planned dumpsters and contractors, and believed the structure was salvageable.
A council member noted that if the city performed work and incurred costs, those costs can be assessed to the property under Minnesota's abatement authorities (assessment terms and interest rate are set by statute), although in the short term the city would pay for work and later assess the property. Staff said the assessment period is limited by statute and the agreement contains enforcement and assessment provisions.
Councilor Herrick (name used in roll call earlier during the meeting) and others urged that the 15-day timetable be realistic and that extensions be avoided absent strong justification. After a motion that incorporated the amendment noted in the community development director's memorandum dated 02/11/2025, the council conducted a voice vote; the motion passed.
