Votes at a glance: Lee County commissioners approve parking-code review, disaster debris contracts, Daniels Parkway change and other measures

The Lee County Board of County Commissioners approved a series of administrative and regulatory actions Feb. 4, 2025, including directions to draft zoning amendments for two historic districts, authorization of disaster debris cleanup contracts, and a controlled-access modification to Daniels Parkway. Most motions passed unanimously.

Staff and commissioners moved through the administrative and public-hearing items with short presentations and brief discussion before votes.

Parking requirements, Boca Grande and Montclair historic districts Miki Resulzby (planning staff) asked the board to direct staff to draft amendments that would allow a parking reduction for the Boca Grande and Montclair Historic Districts similar to the county’s mixed-use overlay. The board voted unanimously to direct staff to prepare the amendments and to send them through advisory committees before returning for final consideration.

Disaster debris cleanup and monitoring — ~ $16.56 million Christine Brady presented contracts and expenditures for hurricane debris cleanup and monitoring. The board approved expenditures for Crowder Gulf in the amount of $13,939,407.58; Thompson Consulting Services for monitoring, $2,441,863.25; and Waste Pro for disaster debris cleanup in Area 4 for $181,322.11 — collectively a little over $16 million for expenses incurred to date. Motion by Commissioner Raines, second by Commissioner Greenwell; the motion carried unanimously.

Daniels Parkway controlled-access modification Jillian Schoeller with DOT presented a requested modification to the Daniels Parkway controlled-access resolution to add a new right-in access point on southbound Daniels Parkway approximately 800 feet south of State Road 82. The request was made by the Gateway Marketplace development; the developer will construct a right-turn lane. Staff reported the access meets separation requirements and does not present a public-safety threat. Commissioner Pendergrass moved the item; Commissioner Hammond seconded. The board approved the modification unanimously.

Lee County Utilities fee schedule changes (public hearing) Amanda Swindle, county attorney, opened a legally advertised public hearing on proposed changes to Lee County Utilities’ miscellaneous fee and capacity fee schedule. Pam Keyes of Lee County Utilities explained these are development and capacity fees, not monthly operational rates. A public commenter asked whether a pending fluoride decision could affect utility costs; Keyes responded that fluoride is an operational matter covered by monthly billing and separate from the capacity-fee schedule. The board adopted the fee-schedule changes by unanimous vote.

School-zone camera enforcement (direction to draft ordinance) Commissioner Pendergrass moved and the board directed DOT staff to pursue information and a framework for school-zone camera enforcement at eligible school zones in unincorporated Lee County, noting recent state statute amendments allowing such programs. Staff said adopting the program would require a county ordinance and that, if implementation by the 2025–26 school year was desired, staff could seek to piggyback on an existing contract to meet the timeline. The motion passed unanimously.

Duke Farms stewardship district (letter of no objection) Commissioner Malacca asked the board to send a statement of no objection to the local legislative delegation for a proposed Duke Farms stewardship district (a local bill covering approximately 1,134 acres). The board voted to send a letter of no objection; staff and the county attorney clarified that legislative approval of a stewardship district is not a land-use approval and that future comp-plan or zoning approvals would follow separate processes.

Appointments and housekeeping votes The board also approved routine consent items and a series of advisory-board appointments and reappointments, all by unanimous vote as recorded on the meeting agenda.

Why it matters: Taken together, these routine and technical approvals authorize immediate operational steps (debris cleanup contracts), begin a formal review and drafting process for code changes (historic-district parking, school-zone camera ordinance), and signal local legislative support for a parcel-based stewardship district.
