Jury convicts Edgar Hernandez Aguilar on two aggravated-assault counts; finds lesser assault on third

At a hearing in the 187th District Court, Judge Stephanie Boyd read jury verdicts finding Edgar Hernandez Aguilar guilty on two counts of aggravated assault with a deadly weapon and guilty of the lesser included offense of assault on a third count, while acquitting him of aggravated assault on that first count.

The jury’s written verdicts were read in open court. Judge Stephanie Boyd read from the count-1 form: "We, the jury, find the defendant Edgar Hernandez Aguilar not guilty of the offense of aggravated assault with a deadly weapon as charged in count 1 of the indictment." She then read the lesser-included finding: "We, the jury, find the defendant Edgar Hernandez Aguilar guilty of the less included offense of assault under count 1." The judge also read the forms for the other charges: "We, the jury, find the defendant Edgar Hernandez Aguilar guilty of the offense of aggravated assault with a deadly weapon as charged in count 2 of the indictment," and similarly for count 3.

Judge Boyd asked whether anyone wished to have the jurors polled; the jurors individually answered "Yes" when the judge asked if the announced verdicts were theirs. After the court recorded the verdicts, Judge Boyd said the court would follow the jury’s findings and enter convictions consistent with those verdicts.

The court scheduled sentencing. Judge Boyd set sentencing for "the eighteenth, Tuesday" at "01:30," telling counsel and the defendant that the hearing would take place then. She also said witnesses may appear by Zoom and instructed counsel to notify the court in advance if a witness will need an interpreter so the court can arrange the Zoom session for interpretation.

Defense counsel indicated there were no defense witnesses wishing to appear at the sentencing hearing, responding, "No, judge." The court confirmed both sides would be able to have witnesses appear by Zoom if needed and asked that parties alert the court beforehand about interpreter needs.

No further factual findings, victim-impact statements, sentencing recommendations, or specific sentencing calculations were announced at the hearing. The court invited attorneys to return to speak with jurors briefly off the record and closed by reiterating the sentencing date and time.

Sentencing is scheduled for Tuesday the 18th at 1:30 p.m.; the month and year were not specified on the record. The court allowed parties to present witnesses by Zoom and asked counsel to notify the clerk in advance if an interpreter would be required for remote testimony.
