Committee forwards nine regulation packages to rename DHEC as Department of Environmental Services

A South Carolina legislative committee voted to forward nine regulatory packages that update references to the Department of Health and Environmental Control (DHEC) following the agency's restructuring under Act 60 of 2023. The packages replace the old agency name with the newly used Department of Environmental Services (DES), update bureau and division names, and make conforming code citation and definition changes.
Rebecca Scrolls, representing the agency, told the panel the packages are non-substantive and reflect only name and structural changes required by the restructuring law. “We have 9 packages that we are bringing forward and as Alan said, those are just changing our name. We've updated references to the board since the old DHEC board no longer exists. So, this is all conforming with Act 60 of 2023,” Scrolls said.
Most packages moved unanimously on voice votes to the full committee with recommendations for approval. The committee approved forwarding regulations that update the agency name in On-site Wastewater Systems, Air Pollution Control Regulations, permits for construction in navigable waters, the Bureau of Land and Water Management, the Bureau of Water, the dams and reservoir safety rules, and other related packages.
One package — the Bureau of Coastal Management regulation — was the subject of a committee request to withdraw and resubmit so the agency could fix definition numbering that was drafted from an older version of the regulatory code. The motion to withdraw and resubmit was approved on a voice vote.
Committee members did not propose substantive amendments during the hearing and recorded no public comments on the packages. The panel completed the agenda items by voice votes recorded as “Aye.”
