Committee forwards nine Department of Environmental Services regulation packages, one withdrawn for renumbering

Representative Bill Taylor, chair of the Regulations and Administrative Procedures Committee, presided as the panel considered a series of rulemaking packages to update agency names and conform internal citations following the restructuring of the former Department of Health and Environmental Control.
Rebecca Scrolls, representing DES, told the committee the packages are largely non-substantive updates to replace references to the former DHEC and to correct bureau and division names, definitions and code citations to conform with Act 60 of 2023.
"Right. So we have 9 packages that we are bringing forward and and as Alan said, those are just changing our name. We've updated references to the board since the old DHEC board no longer exists. So, this is all conforming with Act 60 of 2023," Scrolls said. She told the committee one package requires a withdraw-and-resubmit because the agency began work in an older version of the regulation text and some definition numbering is now out of date.
Committee members moved and the panel voted, by voice, to send the following documents to the full committee with the recommendation that each be approved, except where noted below:
- Document 53 23: Updates to Department of Environmental Services regulations (title/agency-name changes). - Document 5,324: On-site Wastewater Systems (conforming agency-name changes). - Document 5,325: Air Pollution Control Regulations (conforming agency-name changes). - Document 53 26: Permits for construction in navigable waters (conforming agency-name changes). - Document 5,327: Bureau of Coastal Management (withdrawn and to be resubmitted to fix section numbering). - Document 53 28: Bureau of Land and Water Management (conforming agency-name changes). - Document 5,333: Bureau of Water (conforming agency-name changes). - Document 53 37: Dams and Reservoir Safety Act regulations (conforming agency-name changes). - Document 5,343: Additional conforming agency-name updates.
When the Bureau of Coastal Management packet was introduced, committee members agreed to a motion to withdraw and have the agency resubmit corrected text rather than advance flawed numbering. For the other eight packages the committee approved motions to forward them to the full committee with recommendations to approve; members responded "Aye" on each voice vote. No substantive policy changes were described in the meeting.
The packages implement non-substantive renaming and citation corrections after the statutory restructuring of the former DHEC; agencies said the updates reflect new bureau names and replace references to the former DHEC board with a director where appropriate. The committee did not receive public comment on these items during the meeting.
