One commissioner proposed tying a conditional-use permit’s continued validity to property-tax status — for example, drafting a condition that the permit remains valid only while property taxes or payments in lieu of taxes are maintained. Staff said attorney review would be required because conditional-use conditions must address expected impacts and be proportional.
No formal action was taken; staff said it will return to council with options and legal review. Commissioners asked staff to consider a range of measures, including definition adjustments, administrative procedures and potential conditions on future conditional-use permits. Staff indicated the matter will return to council and could be assigned to the planning commission for detailed drafting if council requests it.
