Commission forwards Chapter 5 permit and conditional-use amendments to commissioners

The commission recommended approval of amendments to Chapter 5 of the Albany County zoning resolution, which codify standards and application contents for site plans, zoning certificates and conditional-use approvals.

Staff said the package clarifies required application contents, adds standards for building plans and site plans, and establishes timelines and consistency between zoning certificates and conditional-use permits. A new requirement in the draft asks that site plans for lots 2 acres or less be prepared and stamped by a professional surveyor. The draft also increases the period after which a conditional use expires from one year to two years in cases of nonuse or abandonment to align with the zoning certificate timeline.

Commissioners opened a public hearing; staff reported no public comments had been received during the review period. Commissioners discussed wording changes for readability and asked staff to confirm that the proposed language regarding availability of public services should remain firm language requiring proof (for example, proof of water connection) rather than a looser "can be made available" phrasing; staff explained that in some cases the board wants proof of utility connections or permissions. Commissioners also asked staff to flag apparent inconsistencies about whether the Planning and Zoning Commission makes recommendation only or whether the board may revise what is transmitted; staff agreed to consult the county attorney on that point.

The commission then moved to recommend approval of the Chapter 5 amendments to the Board of County Commissioners; the motion passed by roll-call vote and staff will forward the package for BOCC consideration.
