The Framingham City Zoning Board of Appeals voted Jan. 8, 2025 to send a letter to the Building Commissioner requesting an investigation into whether the property at 91 Grant Street is operating in accordance with a prior ZBA decision. The board voted unanimously to authorize a letter on ZBA letterhead that the chair will sign on behalf of the board; members asked that the letter cite the prior decision and request an investigation (which may include an inspection) and allow the Building Commissioner discretion about reporting back.
Board member Ted and other members said the request grew out of complaints and the board—s own review of past decisions: the board—s 2018–2019 decision on the parcel limited how the site could be used (members said the prior case allowed a small number of cars for sale and a separate allowance for detailing in the rear lot). Board members said a recent drive-by showed substantially more vehicles on the property than they believed had been allowed under the prior decision.
"We made a decision and this property is not being managed the way the decision was; we would like you to verify that," one board member said during the discussion. Members agreed the matter warranted an official request from the board rather than an individual complaint because it relates directly to a past ZBA ruling.
The board asked staff to draft and finalize the letter. One board member asked that the letter cite the ZBA case number referenced in the record; the record shows a case citation was discussed but the transcript does not print the full citation. The board also authorized that the letter should request an investigation (which may include an inspection) at the commissioner—s discretion and that the Building Commissioner report back to the board if appropriate.
