The City Commission approved staff-recommended terms for the Blue Crab Festival agreement with promoter RQ Music on Feb. 13 and instructed staff to obtain a signed contract quickly or present contingency plans.
City Attorney Jane West told commissioners that the promoter had received $50,000 last September but a signed contract remained outstanding. Staff circulated a counter-offer and recommended responses that would limit city financial exposure: reduce festival days, limit city responsibility for emergency services, retain city rights to use festival intellectual property for marketing, and specify a refund mechanism if the contract is terminated. Staff proposed that if the contract is terminated by either party the promoter refund $40,000 of the $50,000 previously disbursed.
Commissioners discussed the risk of taking on promoter requests that would shift significant expense to the city. The city manager and legal staff said accepting additional promoter responsibilities could add roughly $36,000 in fiscal costs compared with staff-recommended terms. The commission voted to accept staff responses and ask legal and community affairs to finalize a contract, while giving the promoter a short deadline to sign. If no signature is obtained within the window the commission directed staff to develop a backup plan for the festival.
Commissioners noted the promoter has been difficult to meet with in person and that final negotiations were delayed by health and scheduling issues. The motion to accept staff terms carried, with one commissioner recording a dissent on the floor. The commission did not specify a precise vote tally in the record; staff were asked to return with progress within approximately 10 days.
