A special magistrate found that the structure at 26014 Southwest Fourth Avenue in Newberry violates the City of Newberry’s dangerous buildings and maintenance codes and ordered the owner to bring the property into compliance within 30 days.
City of Newberry code enforcement presented a timeline of complaints and reinspections beginning July 2024, photos of the property showing deteriorated exterior conditions and debris, and correspondence. The city’s presentation said the property is approximately 0.32 acres (parcel 01983-001-000), zoned RSF-MH-2 and not homesteaded. The city recommended a 30-day compliance period, a $50 daily fine if compliance is not achieved, assessment of full cost of prosecution of $150, and authorization to impose a lien if necessary; the magistrate accepted that recommendation.
Greta [last name not provided], the city presenter, told the magistrate the city received a neighbor complaint July 3, 2024; reinspections on Aug. 20, Sept. 30 and Feb. 3, 2025, showed limited exterior improvements (grass mowing) but continued debris and previous placement of a roll-off container. Greta said city utility records indicated no power or water service at the property at one inspection date and that the city cannot confirm whether someone currently resides there.
The property is located on the west side of Newberry High School; the city noted proximity to the school when explaining community concern. The magistrate entered a finding of violation under City of Newberry code sections cited by staff and ordered compliance within 30 days. The magistrate said the $150 prosecution cost would be waived if compliance is achieved within the 30-day period.
The transcript records that a roll-off container visible on Nov. 4, 2024, was later removed and that the last city photo in the file was taken Feb. 3, 2025. The city posted the property in City Hall on Feb. 3, 2025, and requested the special magistrate hearing the same day.
