The Burbank City Council recessed to a closed session at its Feb. 11, 2025, meeting to consider one anticipated litigation matter, two existing personal-injury lawsuits and labor negotiations with the Burbank City Employees Association.
City Attorney (unnamed) told the council the closed-session agenda included “a matter of anticipated litigation pursuant to Government Code section 54956.9(d)(2) with the city as a potential defendant in 1 case,” and two matters of existing litigation under Government Code section 54956.9(d)(1): Tremblay v. City of Burbank (a trip-and-fall personal injury case) and Sonia Elias v. City of Burbank, et al. (does 1 through 50), also described as a trip-and-fall personal injury case. Betsy McClinton, Management Services Director, was named as the city’s labor negotiator for a closed-session conference pursuant to Government Code section 54957.6.
The council record shows there were no public commenters at the start of the meeting; City Clerk (unnamed) said, “There being no public comment, I now declare the public comment period closed, and we will now proceed to a closed session meeting.” The televised portion of the meeting ended; the council said it would reconvene in the council chambers at 6 p.m.
By law, Government Code section 54956.9 permits a local legislative body to meet in closed session to discuss existing or anticipated litigation, and Government Code section 54957.6 permits closed-session discussions of labor negotiations with designated representatives. The transcript does not record deliberations or any votes taken inside the closed session.
Because the matters were scheduled for closed session, there are no public details in the transcript about the substance of the litigation or the bargaining positions that will be discussed. The council invited the public to view the meeting online or by television and to provide public comment in person or by calling the meeting line for the open portions of the meeting.
