Committee adopts amendment to allow virtual septic inspections and limits replacement orders
Summary
Members amended House Bill 15 41 to allow public-health units to perform required septic-system inspections in person or virtually within one business day of notification and to prohibit requiring replacement of a functioning system within 10 years of notice or before sale of property.
Representative Marshall presented amendment 01/2005 to House Bill 15 41, which adjusts on-site inspection timing and local public-health authority over septic-system replacement. Marshall said local installers and public-health inspectors told him a same-day inspection is feasible because permits and schedules are coordinated in advance.
Members debated whether one day was sufficient, with Representative Doctor suggesting 3–4 days given rural travel and staffing constraints. Marshall and other supporters said inspectors typically know planned installation dates and can inspect the same day; the committee then amended the bill to require a local public-health unit to conduct the required inspection in person or virtually within one business day of notification. The amendment also added that a local public-health unit may not require replacement of a repairable, functioning septic system within 10 years of notice of noncompliance or before a property sale, whichever is sooner.
The committee approved the amendment and later gave House Bill 15 41 a due pass as amended.
