The chair of the City Council's Committee on International and Legal Affairs recommended that the committee report out for adoption requests to authorize settlement of six lawsuits and a resolution to retain special counsel, saying the committee reconvened under Hawaii law and no members objected.
The committee reconvened pursuant to Hawaii Revised Statutes sections 92-4 and 92-5(a)(4) to discuss matters appropriate for executive session, then moved to report the following items out for adoption by the full council: a request to authorize settlement in Palma Nohanka v. City and County of Honolulu; a resolution to retain Thompson Co. Cousins and Irons LLP as special counsel to represent dependent Zane DeCambra; a request to authorize settlement in Cefo Fatai v. City and County of Honolulu; a request to authorize settlement in Darlene Tamashiro, individually and as guardian of RB, a minor, v. City and County of Honolulu; a request to authorize settlement in Bonnie Chermack et al v. K. S. Ilima at Lejano LLC et al; and a request to authorize settlement in Nancy Savlet v. City and County of Honolulu.
For each item the chair asked whether there were any objections; the chair then said, "Any objections? Seeing none, thank you." No roll-call votes, movers or seconds were recorded in the transcript for these recommendations. The chair explicitly recommended each item be "reported out for adoption," and the committee provided no objections on the record to those recommendations.
The transcript shows the committee moved from executive session directly into these procedural recommendations and concluded with an announcement that the Committee on Executive Management would convene five minutes after adjournment. The meeting then adjourned.
The actions reported out are procedural committee recommendations; the transcript does not record any formal full-council vote on the underlying settlements or the resolution to retain special counsel.
