Planning commission staff: City Council amended findings and added school definition to commercial zoning ordinance (case file 75-17)

At the Feb. 12 meeting the Troutdale Planning Commission heard a staff update that the City Council amended findings and made a limited textual revision to the commercial zoning chapter associated with case file 75-17.
Staff reported that the council accepted edits to the findings of fact proposed by Commissioner Wilcox and added clarifying red-line language to the ordinance text. The most substantive textual addition the staff highlighted was a definition: for the purposes of the chapter, a public or private school includes a community college or other institution "where students under the age of 18 receive instruction to receive academic credits that apply towards elementary, middle, or high school grades K through 12 and which may also apply towards college advancement credits." Staff said that was added at council’s request to make the code’s intent clearer.
Commissioner Wilcox and staff also discussed edits intended to correct double negatives and to reword a phrase describing consistency with a local ballot measure. Wilcox noted one example in the ordinance language and the staff said it would be revised to read that the change "brings [the code] into conformance with the electorate voting no on measure 26-248 on 11/05/2024," language staff said would be inserted for clarity. Staff said typographical and wording edits submitted by Wilcox would be incorporated into the next staff report for council.
Staff asked the commission to note the council’s edits and said those edits have been posted in the staff report provided to council. No public testimony was reported on the council action at this meeting. Commissioners thanked staff for updating the materials and for following up after the council hearing.
The transcript does not show a new commission vote on case file 75-17 at this meeting; staff characterized the matter as an update on actions taken by the City Council and as confirmation that the commission’s prior edits and the council’s subsequent red-line changes will be reflected in forthcoming staff materials.
