The board cited Colorado Revised Statutes section 24-6-402(4)(b) (conference with the county attorney for legal advice) and section 24-6-402(4)(e) (determining positions relative to matters subject to negotiation and instructing negotiators) as the legal bases for the closed meeting. County Attorney Eric Knauss advised the session would not be recorded because it is covered by attorney–client privilege.
Commissioners and staff later reported for the public record that the executive session had concluded at 11:16 a.m., that the discussion was limited to the stated purposes and that no formal action was taken. Knauss summarized for the record that the conversation addressed legal advice and possible formation of an informal committee to discuss future meetings; he said no formal committee was created and no decisions were finalized during the closed session.
Attendees listed for the executive session included Jay Harrington, Melina Bricker, Matthew Mendisco, Eric Knauss, Helica Salinas and Sonia Macy's. The board returned to open session and adjourned the meeting.
