County manager schedules vendor presentation on jail dormitory repurpose; county attorney requests executive session on legal liabilities

Spina Genesio, Pueblo County manager, told the Board of County Commissioners that the county’s contract vendor Trainer will present design plans for converting a portion of the county jail into dormitory space when the new jail opens. Genesio said Trainer is expected at approximately 11 a.m. and asked the chair how the board wished to pivot the agenda to accommodate the presentation.
Genesio also reported ongoing Workday payroll follow-up: she said she had meetings scheduled with other counties that use Workday to study how they pay nonexempt deputy staff and would report back on options or scheduling formulas those counties use.
Shortly afterward, County Attorney Cynthia Mitchell asked the board for an executive session to receive legal advice under Colorado law. Mitchell told the board she was requesting executive session under Colorado statute to receive legal advice on specific legal questions regarding commissioner liability under the Colorado Governmental Immunity Act, scope of authority, personnel matters, open meetings and open records, the Protecting Opportunities for Workers’ Rights Act, quasi-judicial proceedings, employees’ First Amendment issues related to social media, and a potential contract with the law firm Semple, Farrington, Everall & Case.
After the attorney’s request, a commissioner asked for a motion to enter executive session “for the reason cited.” A motion was made; the board responded “aye” when asked for a voice vote and the chair stated the motion carried. The transcript records the motion and an affirmative voice vote but does not provide a roll-call vote with individual commissioner names and vote positions in the transcript.
