Committee narrows nicotine exemptions, forwards tobacco- and vaping-policy changes to full board

Committee members amended district policy language that had been proposed through the North Carolina School Boards Association model updates to clarify which nicotine- and tobacco-related products are covered and to exempt medically prescribed cessation aids.

Mister David Perry told the committee he was concerned the proposed language had "really conflated the words tobacco product into a whole gamut of things that don't necessarily contain tobacco," and asked the committee to preserve an explicit exception for FDA-approved, prescribed cessation products. Dr. Barnes noted that many CBD- and THC-containing products are already addressed separately under the district's drug policy.

Miss Judy Justice moved to amend the nicotine-product definition in both policy 43-20 and 50-26 to add the phrase "doctor prescribed FDA-approved smoking-cessation product" as an exception; the motion was seconded and passed 3-0. After the amendment, the committee voted 3-0 to forward the amended policies 43-20 and 50-26 (and the related update to 72-50) to the full board for action at its March meeting.

Why it matters: The change narrows the district's disciplinary reach so that medically prescribed cessation products are not treated as prohibited nicotine devices, while maintaining district authority over nonmedical nicotine, tobacco, and vaping products. Committee members discussed enforcement nuances such as over-the-counter nicotine gum or patches being used for non-cessation purposes, and suggested specifying "medical provider" language may be considered in further edits.
