The County Board on Feb. 11 voted to set a public hearing for 9:30 a.m. on March 18 to consider amendments to the Clay County Tobacco Ordinance.
Darren and county legal and public‑health staff explained that the March 18 hearing will review the existing ordinance and consider potential amendments; staff will publish a 10‑day notice with language describing that the hearing will consider possible amendments to the enacted ordinance. The board’s earlier December action had enacted an ordinance with a later June 1 enforcement date; commissioners said the public hearing was requested to reopen and consider targeted changes (several commissioners referenced focusing on vape products as one possible scope for amendment).
Attorney and staff guidance in the work group and during the meeting emphasized that public hearings may be continued and that the board need not act on an amendment the same day as the hearing. The board directed staff to provide proposed amendment language and to run public‑notice steps required by statute. County public‑health staff also noted that the Public Health Law Center assisted with initial drafting of the earlier ordinance and that draft amendments will be circulated ahead of the hearing.
Motion to set the hearing was made and seconded; the chair called for a voice vote and announced the motion carried. The county will publish hearing notice and share proposed language with the board ahead of March 18.
