Judge Tammy Long Hayward awarded NorthStar the damages it sought in a damages hearing after liability was decided by default earlier in the case against 3 D and T Transport LLC.
Beau Hayes, appearing for NorthStar, told the court the leased truck was an entire loss and the lessee had not returned the vehicle. Hayes requested $19,812 in principal, $9,050.12 in contractual interest calculated at 18 percent, attorney’s fees of $2,911.21 under the contract formula, and court costs. The court stated it had received business-records affidavits and found the supporting proofs sufficient.
The judge ruled: “the court is going to grant, $19,812 in principal, $9,050.12 in, interest, contractual interest, and $2,911.21 in attorney's fees, as permitted by the contract.” The court directed counsel to submit a proposed order for signature following the hearing.
The award resolves the damages phase of the case where liability already had been determined by default; the court did not address additional enforcement steps beyond entry of judgment and order preparation.
